Terms of Use
Last updated:
These Terms of Use ("Terms") govern your use of DATAINFO — Kenya Construction Intelligence ("DATAINFO", "we", "us"), a product of PConnect Intelligence. By creating an account or using the service you agree to these Terms. If you do not agree, please do not use the service.
1. The service
DATAINFO provides a searchable directory of Kenyan construction companies and their executives. Basic company information can be browsed after you sign in. Individual contact channels (for example a mobile number, direct line, email address or LinkedIn profile) are masked until you unlock them with credits.
2. Accounts
- You must provide accurate registration details and keep your password secret.
- An account belongs to a company. Company administrators manage the company's users, wallet and credits.
- You are responsible for everything done through your account. Tell us at once if you suspect unauthorised use.
- You must be at least 18 years old and able to enter a binding contract on behalf of your company.
3. Credits and payments
- Contact channels are unlocked with credits. The number of credits each channel costs is shown before you confirm an unlock.
- Credits can be bought online (card or PayPal) or paid for by bank transfer or M-Pesa and added after we confirm the payment. Online card payments are processed by our payment providers; DATAINFO does not see or store your card number.
- Prices are shown in the currency of the payment method you choose. Taxes may apply.
- Credits may have an expiry date when one is shown on your wallet. Credits without an expiry stay in your wallet until used.
- Company administrators may move credits between the company wallet and its users. Credits cannot be exchanged for cash.
- Refunds are covered by our Refund Policy.
4. Permitted use
You may use unlocked contact details for your company's own legitimate business communication — for example to offer products or services, to tender, or to arrange meetings.
You agree to follow the law that applies to you, including data protection and anti-spam rules, and to respect a person's request to stop being contacted.
5. What you must not do
- Copy, scrape, resell, publish or share the directory or unlocked contact details with people outside your company.
- Use automated tools to harvest data or to overload the service.
- Send unlawful, deceptive, harassing or unsolicited bulk messages using details from DATAINFO.
- Try to bypass credits, security or access controls, or to access another company's data.
- Share your login with people who are not part of your company.
6. Accuracy of information
Contact details are collected from public sources and by our field correspondents and are labelled with a confidence tier (Verified, Probable or Unconfirmed) and the date they were last checked. We work hard to keep them correct, but people change jobs and numbers, so we do not guarantee that any detail is complete, current or error-free. Credits spent on an unlock are not refunded only because a detail later proves out of date, except as stated in the Refund Policy.
7. Intellectual property
The directory, its structure, our software, our brand and the content of this site belong to DATAINFO or its licensors. We give you a limited, non-exclusive, non-transferable right to use the service for your company's own business under these Terms.
8. Suspension and ending
We may suspend or close an account that breaks these Terms, puts the service or other users at risk, or is used unlawfully. You may stop using the service at any time and ask us to close your account. Sections that by their nature should continue (for example 5, 7 and 10) continue after closure.
9. Availability and changes to the service
We aim to keep the service available but do not promise it will always be uninterrupted or error-free. We may improve, change or remove features and may update prices; changes to credit prices do not affect credits you have already bought.
10. Liability
To the extent the law allows, DATAINFO is not liable for indirect or consequential loss, lost profit or lost business arising from your use of the service, or for decisions made using information from the directory. Our total liability for any claim is limited to the amount you paid us for credits in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
11. Changes to these Terms
We may update these Terms. When we make an important change we will tell you on the site or by email. If you keep using the service after the change takes effect, you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction, unless mandatory law where you live says otherwise.
